1. Acceptance of Terms
By installing, configuring, or using the MakeItCustom Shopify application ("the App", "we", "us", or "our"), you ("Merchant", "you", or "your") agree to be legally bound by these Terms of Service. If you do not agree with any portion of these Terms, you must immediately uninstall and discontinue use of the App.
2. Eligibility & Shopify Platform Requirements
To install and use MakeItCustom, you must:
- Maintain an active, valid Shopify merchant account in good standing.
- Comply with all applicable Shopify Partner Program and Merchant Terms of Service.
- Have the legal authority to bind your organization or business entity to these Terms.
3. Merchant Responsibilities & Acceptable Use
As a merchant utilizing MakeItCustom on your Shopify storefront, you are solely responsible for:
- Product & Template Setup: Correctly configuring template dimensions, print areas, DPI settings, measurement units (inches/mm), and allowed personalization tools (text, font selectors, color pickers, image uploads).
- Pricing & Fee Configuration: Setting and verifying customization surcharges and fee rules attached to your products.
- End-Customer Content & Intellectual Property: Ensuring that any artwork, graphics, logos, trademarks, and text uploaded or personalized by you or your end-customers comply with all applicable intellectual property, trademark, and copyright laws.
- Prohibited Content: You agree not to use the App to process, store, or generate files containing defamatory, obscene, infringing, hateful, violent, or illegal content.
4. Production File Review & Manufacturing Disclaimer
MakeItCustom provides automated rendering software that converts customer Design JSON into print-ready PNG and PDF assets based on your configured physical dimensions and DPI.
Merchants are solely responsible for reviewing and verifying all generated production files, print alignment, bleed margins, color profiles, and typography before sending files to physical manufacturing, printing, engraving, embroidery, or fulfillment equipment.
We make no warranty that customer-uploaded low-resolution imagery will reproduce with high fidelity on physical goods. The quality of customer-supplied raster graphics remains the responsibility of the merchant and customer.
5. Pricing & Billing
Applicable subscription plans, usage tiers, or transaction fees (if any) will be clearly disclosed to you through the Shopify Billing API prior to activation. Any recurring or usage-based charges will be billed directly through your standard Shopify invoice.
If you are utilizing a free tier or development preview, access is provided without charge subject to these Terms. We reserve the right to modify plan structures with advance notice via Shopify Admin.
6. Intellectual Property Rights
- Our Proprietary Rights: MakeItCustom, including all source code, algorithms, visual editors, user interfaces, cryptographic signing protocols, and documentation, is the exclusive intellectual property of the App Operator and its licensors.
- Merchant Rights: You retain all intellectual property rights, ownership, and title to your catalog items, merchant brand assets, product mockups, and customer design artwork.
- Limited License: By installing the App, you grant us a limited, revocable, non-exclusive license to process, render, and store your templates, design JSON, and uploaded artwork solely to provide the services described herein.
7. Third-Party Services & Infrastructure
MakeItCustom operates in conjunction with third-party providers, including Shopify Inc., Railway Corp., Neon Inc., and Cloudflare Inc. While we strive for continuous service uptime, we are not liable for service interruptions, API rate limits, network latency, or downtime originating from third-party hosting or platform providers.
8. Suspension & Termination
By Merchant: You may terminate this agreement at any time by uninstalling MakeItCustom from your Shopify Admin.
By Operator: We may suspend or terminate your access to the App immediately if you violate these Terms, engage in fraudulent or abusive activities, or if required by Shopify platform policies or legal authorities.
9. Disclaimers of Warranties
MAKEITCUSTOM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE APP WILL BE UNINTERRUPTED, COMPLETELY ERROR-FREE, OR FREE FROM TEMPORARY TECHNICAL DELAYS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAKEITCUSTOM, ITS OPERATORS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PHYSICAL PRINTING SCRAP/WASTE, OR OTHER BUSINESS LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE APP IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE INCIDENT GIVING RISE TO LIABILITY.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated revision date. Continued use of MakeItCustom following the posting of modifications constitutes your acceptance of the updated Terms.
